1 – Interpretation and Definitions 1.1 – Interpretation
Words with initial capital letters have meanings defined under the following conditions. These definitions apply equally whether in singular or plural.

Buyer refers to users placing Orders for Goods through the Service.

Order means a Buyer’s confirmed purchase request for Goods through the Application or Website.
Seller refers to users who list Goods for sale or trade.
Service refers to the Rareboots Marketplace Application and Website.
Terms of Service (“Terms”) refer to this agreement between You and the Company.
Third-party Social Media Service refers to external platforms integrated with or referenced by the Service.

You refers to the individual or legal entity using the Service.

3 – Acknowledgment

5 – User Accounts 5.1 – Account Creation
You must provide accurate, complete information when creating an Account.
Usernames that impersonate others, violate trademarks, or are offensive are prohibited.
5.2 – Account Information
You may be required to provide:
Name
Phone number
Address
Identity verification documents
Payment details (Stripe, PayPal, or other methods)
Payout details for Sellers
5.3 – Account Review
We do not perform background checks. Users are responsible for their information.
5.4 – Password Security
You are responsible for safeguarding Your password and notifying Us of any unauthorized access.
5.5 – Account Termination
We may suspend or terminate Your Account immediately if You violate these Terms.
6 – Content 6.1 – User-Generated Content
You are responsible for any Content You post.
By posting Content, You grant Us a worldwide, royalty-free license to use, display, modify, and distribute it for Service operation and promotion.
6.2 – Content Restrictions
Prohibited Content includes:
Illegal items
Counterfeit football boots or fake products
Misleading or fraudulent listings
Offensive, harmful, or discriminatory material
Malware or harmful software
Copyright-infringing images or text
Impersonation
False information
We may remove any Content at Our discretion.
6.3 – Backups
We do not guarantee Content backups. Keep local copies of Your data.
6.4 – Copyright & IP
We comply with DMCA, UK copyright law, and EU directives. Copyright owners may request removal of infringing material.
7 – Orders of Goods
Rareboots Marketplace acts ONLY as a facilitator between Buyers and Sellers. We do not own, inspect, or guarantee any Goods listed on the platform.
7.1 – Marketplace Position
We are not a party to sales agreements between Buyers and Sellers. All Goods are provided by Sellers.
7.2 – Buyer Information
Buyers must provide complete and accurate payment and shipping information.
7.3 – Accuracy, Errors, Availability
Sellers are responsible for their listings. We do not guarantee accuracy, condition, or availability.
7.4 – Pricing
Sellers control pricing. Prices may change before Order acceptance.
7.5 – Payments (Escrow Model)
Payments are processed via third-party providers (Stripe, PayPal, etc.).
Funds are held in escrow until:
Seller ships the item
Tracking confirms delivery
Buyer confirms satisfaction / or auto-confirms after a defined window
Only then are funds released to the Seller.
7.6 – Service Fees
Buyers and/or Sellers may be charged service fees, shown at checkout.
7.7 – Order Modification
Any modifications agreed between Buyer and Seller may adjust total payment.
7.8 – Order Cancellation 7.8.1 – Company Cancellation Rights
We may cancel Orders for:
Fraud
Counterfeit products
Violations of these Terms
Seller failure to ship
Incorrect product information
7.8.2 – Buyer Cancellations
Once an Order is placed, Buyers typically cannot cancel unless exceptional circumstances apply.
7.8.3 – Seller Cancellations
If a Seller cancels, the Buyer receives a full refund.
7.9 – Order Disputes (Buyer Protection)
Buyers may open disputes if:
The item is counterfeit
The item is not as described
The wrong size/model was delivered
The item never arrived
Rareboots Marketplace resolves disputes at our sole discretion.
8 – Disclaimer of Warranties & Liability 8.1 – Limitation of Liability
Our liability is limited to the lesser of:
The amount You paid through the Service, or
$100 USD (or equivalent)
We are not liable for:
Loss of profits
Loss of data
Business interruption
Counterfeit goods sold by Sellers
Shipping delays or carrier issues
Disputes between users
8.2 – “AS IS” Service
The Service is provided “as is” without warranties of any kind.
8.3 – External Links
We are not responsible for third-party websites linked from the Service.
8.4 – Translation
In case of conflict, the English version of these Terms prevails.
9 – Disputes Resolution
If You have a dispute with the Service, You agree to contact Us first to attempt an informal resolution.
10 – Intellectual Property of the Service
Rareboots Marketplace branding, logos, content, code, and platform materials are owned by the Company and may not be used without written permission.
11 – Your Feedback to Us
Any Feedback You provide becomes the property of Rareboots Marketplace. If not assignable, You grant Us a perpetual, worldwide, royalty-free licence to use it.
12 – Changes to These Terms
We may update these Terms at any time. If changes are material, We will give reasonable notice (email, app notification, or website banner).
By continuing to use the Service after changes take effect, You agree to the revised Terms.
